What Is THCA and Why the Confusion?
Tetrahydrocannabinolic acid, or THCA, is the non-intoxicating cannabinoid found in raw cannabis flower. When heated, it converts to delta-9 THC — the psychoactive compound in traditional cannabis. That chemical transformation is the source of legal confusion across the United States.

What the 2018 Farm Bill Really Says
The 2018 Farm Bill federally legalized hemp, defining it as cannabis containing less than 0.3% delta-9 THC by dry weight. THCA, being non-psychoactive in its raw form, is not included in that definition—so long as the product remains under that 0.3% limit for delta-9 THC.
However, some federal agencies, like the DEA, have taken the position that THCA should be included in a product’s total THC measurement because it converts to delta-9 when heated. In a 2023 letter, the DEA stated that “all THCA must be considered when determining legality.”
Despite this, most hemp businesses—and many states—still rely on the dry weight delta-9 measurement only. That’s where third-party lab reports come in.
